§ 58-48. Assessment procedure.

  • If the city repairs a sidewalk under section 58-47, it shall assess 50 percent of the cost of such repairs upon the owner of the lot or premises adjacent to and abutting upon the sidewalk. The assessment shall be due 30 days after the date the owner receives the assessment, and shall be subject to five percent annual compounded interest thereafter. If the cost of repair attributable to the owner is not paid in full within 30 days, then the cost shall become a levy on the property and added to the next tax bill. If payment of the assessment creates a financial hardship, the owner may request the city manager extend the payments over a period of time. If the city manager grants the request, the property owner and city manager shall agree as to the amount, the interest rate to be charged, and the term for repayment. The amount shall be a levy on the property and collected on subsequent tax bills. If the city manager declines to extend the payment, the owner may appeal to the city council.
